NHRCCB ANTI CORRUPTION CELL

In India, several laws address anti-corruption, including the Prevention of Corruption Act, 1988, the Indian Penal Code, and the Benami Transactions (Prohibition) Act, 1988. The Prevention of Corruption Act criminalizes the taking and giving of undue advantage to public servants, while the Indian Penal Code deals with offenses like bribery and criminal misconduct. The Benami Transactions (Prohibition) Act prohibits the illegal holding of property by one person on behalf of another. Additionally, the Prevention of Money Laundering Act, 2002, penalizes public servants for money laundering. The Prevention of Corruption Act, 1988, This is the primary law that criminalizes corruption, including the taking and giving of "undue advantage" to public servants. It also covers offenses like criminal misconduct, where a public servant dishonestly or fraudulently misappropriates property under their control or allows others to do so. The Indian Penal Code, 1860 (IPC),This code includes provisions related to various offenses, including bribery, cheating, and breach of trust, which can be used to prosecute corruption cases. The Benami Transactions (Prohibition) Act, 1988,This act aims to prevent the illegal holding of property by one person on behalf of another, which can be used to conceal assets derived from corrupt activities.The Prevention of Money Laundering Act, 2002,This law penalizes public servants for the offense of money laundering, which is often used to hide the proceeds of corruption. The Lokpal and Lokayuktas Act, 2013,This act establishes the Lokpal for the Union and Lokayuktas for states to inquire into allegations of corruption against certain public functionaries, including the Prime Minister and cabinet ministers. The Right to Information Act, 2005,This act grants citizens the right to access information from government, which can be used to expose corruption and hold public officials accountable. The Foreign Contribution (Regulation) Act, 2010 (FCRA), This law regulates the receipt and use of foreign contributions by non-governmental organizations and can be used to track and prevent corruption related to foreign funds.

NHRCCB Anti-Corruption Cell aims to promote anti-corruption prevention/control and other activities related to promotion and protection of anti- corruption across the nation in support of NHRCCB Volunteer/ Member/ Officer.

For the implementation different laws related anti-corruption prevention/control as per Indian Constitution, NHRCCB established a separate Constituent unit or cell named “ NHRCCB Anti-Corruption Cell ” with independent managing committee.
